Filing a notice of claimed infringement
To be effective under 17 U.S.C. § 512(c)(3), your notice must be in writing and include:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
- Identification of the material that is claimed to be infringing and that is to be removed or disabled, with information reasonably sufficient for us to locate it (for example, the page URL and a description of the image or text).
- Information reasonably sufficient to permit us to contact you, such as your name, mailing address, telephone number and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Send notices to the designated agent above. Please note that under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages.
Counter-notification
If material you posted (for example, an event you submitted to our calendar) was removed and you believe it was removed by mistake or misidentification, you may send a counter-notification under 17 U.S.C. § 512(g)(3) to the designated agent. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed or to which access was disabled, and the location where it appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which OwnUtah.com may be found), and that you will accept service of process from the person who provided the original notice or that person's agent.
When we receive a valid counter-notification, we will send a copy to the person who filed the original notice and tell them we will restore the material in 10 business days. We will restore the material no fewer than 10 and no more than 14 business days after receiving the counter-notification, unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringement.
Repeat infringers
We will, in appropriate circumstances, stop accepting submissions from users who are repeat infringers.
