"St. George Utah short term rental laws" is a very common search, and the rules surprise a lot of buyers. In both Ivins and St. George, nightly rentals are not allowed in ordinary residential neighborhoods.
Ivins
- Short-term residential leases, meaning under 30 days, are prohibited in all residential zones, except a legal bed and breakfast inn or a mixed-use overlay with resort commercial (Ivins Code 16.12.123).
- The Short Term Rental Overlay (STRO) is permitted only in areas already approved and vested under Ordinance 2015-04. No new STRO applications are accepted in residential zones (Ivins Code 16.07.802).
St. George
- Short-term rentals are allowed only in commercial zones and approved resort overlay zones. A resort overlay generally needs a minimum number of units, written consent of 100% of owners in the recorded plat, and CC&Rs that allow short-term rental (overview; city code Title 10).
- Each short-term rental needs a city business license, which is not transferable to a new owner. Owners must collect transient room tax, remove garbage within 24 hours of guests leaving, clean between stays, and designate a local property manager available 24 hours a day (St. George Code 3-2V-1).
- The city publishes an approved properties list and map on its business licensing page.
Santa Clara, Washington and Hurricane
Each city has its own ordinance. Check with the city's planning or business licensing office for the specific parcel before you buy.
Before you buy for rental income
- Confirm the parcel's zoning and any overlay with the city.
- Read the HOA CC&Rs, which can be stricter than the city.
- Plan for your own business license; the seller's doesn't transfer.
- Budget for a local property manager.
